Dram Shop Law and Liability


Be careful who you serve at your bar, nightclub or event.  If you serve a visibly intoxicated person, and that person gets into a fight or car accident, you may be liable.  

“The law until about 30 years ago basically didn’t permit you to sue the bar. It was basically that people had free will, and it was their choice to drink,” Charles Monnett said Thursday. “It has evolved to the point where in North Carolina, if you serve an individual who was intoxicated and you know or should know that they’ll be driving shortly thereafter, then you’re responsible.”

Be sure you know your state's dram shop law and take every protection necessary to prevent something like this happening again.  It is better to be over cautious rather than under cautious.
