Dram Shop laws hold venues who serve alcohol liable for providing alcohol to those who are visibly intoxicated or underage and later cause a car crash or other accident.
New York is proposing to alter its Dram Shop law to hold liable those who sell fake drivers licenses to minors who cause injury or damages while intoxicated. However, the proposal carves out "an affirmative defense for a seller...who has scanned and relied upon an apparent government identification card which stated that the recipient was twenty-one or older."
Moral of the proposed law? Get an ID scanner to protect your venue, your investment and your employees.
